In the lawsuit filed by shareholders of TEPCO seeking compensation from five former executives for the massive damages caused by the Fukushima Daiichi nuclear accident, the Tokyo High Court rejected the shareholders claim and did not recognize the former executives responsibility, in contrast to the first trials ruling that ordered over 13 trillion yen in compensation, stating that it cannot be said that there were circumstances in which a massive tsunami could have been predicted.
東京電力の株主たちは、原発事故が起きたのは安全対策が不十分だったためだとして、旧経営陣5人に対し、被害者への補償や廃炉、除染にかかった費用など23兆円あまりを会社に賠償するよう求めています。
Tokyo Electric Power Company shareholders claim that the nuclear accident occurred due to insufficient safety measures, and are demanding that five former executives pay over 23 trillion yen to the company to cover costs such as compensation to victims, decommissioning, and decontamination.
1審の東京地方裁判所は元会長ら4人の賠償責任を認め、国内の裁判で最高額とみられるあわせて13兆3210億円の賠償を命じ、双方が控訴しました。
The Tokyo District Court of first instance recognized the liability for damages of the former chairman and three others, ordering them to pay a total of 13.321 trillion yen in compensation, which is believed to be the highest amount ever awarded in a domestic trial. Both sides have appealed the decision.
▽株主側は、国の機関が2002年に地震の予測についてまとめた「長期評価」に基づき巨大津波への対策をとるべきだったと主張した一方、▽旧経営陣側は「長期評価の信頼性は低く、巨大津波は予測できず、対策をしても事故は防げなかった」などとして責任はないと主張しました。
The shareholders argued that countermeasures against a massive tsunami should have been taken based on the long-term assessment compiled by a government agency in 2002 regarding earthquake predictions. On the other hand, the former management claimed that the long-term assessment was unreliable, that a massive tsunami could not have been predicted, and that even if countermeasures had been taken, the accident could not have been prevented, thus denying responsibility.
6日の判決で東京高等裁判所の木納敏和裁判長は「『長期評価』は原発の事業者として尊重すべきものではあるが、運転を停止させて津波対策を講じるほどの法的な義務があったとは必ずしも言えない。
In the ruling on the 6th, Chief Judge Toshikazu Kino of the Tokyo High Court stated, The long-term assessment is something that should be respected by nuclear power plant operators, but it cannot necessarily be said that there was a legal obligation to halt operations and implement tsunami countermeasures.

巨大津波を“予測できたか” “対策取れたか” 大きな争点に
福島第一原発事故については、東京電力や旧経営陣それに国の責任がさまざまな裁判で争われ、この中では▽原発を襲った巨大津波の発生を事前に予測できたかどうかと▽予見した場合に事故を防ぐ対策を取ることができたかどうかという2点が大きな争点となってきました。
Could the massive tsunami have been predicted? Could countermeasures have been taken? These have become major points of contention. Regarding the Fukushima Daiichi nuclear accident, the responsibility of TEPCO, its former management, and the government has been contested in various court cases. The two main points of dispute in these cases have been: whether it was possible to predict the occurrence of the massive tsunami that struck the nuclear plant in advance, and whether, if it had been foreseen, countermeasures could have been taken to prevent the accident.
このうち巨大津波を予測できたかどうかをめぐっては、事故の9年前の2002年に国の地震調査研究推進本部が公表した地震・津波の『長期評価』の信頼性が判断のポイントになっています。

旧経営陣が強制起訴され、ことし3月に全員の無罪が確定した刑事裁判の最高裁決定では、『長期評価』の信頼性について「巨大津波の現実的な可能性を認識させる情報だったとまでは認められない」として、旧経営陣は巨大津波の現実的な可能性を認識していたとは言えないと認定しています。
In the Supreme Court decision on the criminal trial in which the former management was forcibly indicted and all were acquitted in March of this year, regarding the reliability of the long-term evaluation, it was determined that it cannot be recognized as information that made them aware of the realistic possibility of a massive tsunami, and thus, the former management was not recognized as having been aware of the realistic possibility of a massive tsunami.
一方で株主たちが起こした今回の民事裁判の1審判決では「自然現象の予測に過度の信頼性を求めると対策が不十分となり、原子力発電所の安全性の確保がはかれない事態が生じかねない」と指摘した上で、『長期評価』については「一定のオーソライズがされた相応の科学的信頼性を有する知見」だと認定しました。
On the other hand, in the first-instance ruling of the civil lawsuit filed by the shareholders, the court pointed out that “if excessive reliability is demanded in the prediction of natural phenomena, countermeasures may become insufficient, potentially resulting in a situation where the safety of nuclear power plants cannot be ensured.” Regarding the “long-term evaluation,” the court recognized it as “knowledge with a certain degree of scientific reliability that has been appropriately authorized.”
