The U.S. Supreme Court has ruled that, in the lawsuit seeking an injunction against the executive order signed by President Trump, the injunction issued by the federal district court, in principle, applies to the plaintiffs and does not apply nationwide.
トランプ大統領の政策が、一部の連邦地裁の命令で差し止められるケースが相次いでいただけに、トランプ大統領は「大勝利だ」としています。
President Trump called it a huge victory, as his policies had repeatedly been blocked by orders from some federal district courts.
アメリカで生まれた子どもには両親の国籍にかかわらずアメリカ国籍を与える、いわゆる「出生地主義」を見直すとした、トランプ大統領の大統領令の差し止めを求めた裁判で、連邦最高裁判所は27日、「出生地主義」を見直すことが憲法に違反するかどうかの判断を示しませんでした。
In the lawsuit seeking an injunction against President Trumps executive order to review the so-called birthright citizenship, which grants American citizenship to children born in the United States regardless of their parents nationality, the U.S. Supreme Court on the 27th did not make a decision on whether revising birthright citizenship would violate the Constitution.
その一方で、連邦最高裁は、連邦地方裁判所が、大統領令の効力を差し止めると判断をした場合、その対象となるのは原則として訴えを起こした個人や団体、州などだとし、一部の連邦地裁が下した差し止めの命令は、全米一律には適用されないという判断を示しました。
On the other hand, the Supreme Court ruled that when a federal district court decides to suspend the effect of a presidential executive order, in principle, the suspension applies only to the individuals, organizations, or states that filed the lawsuit. The Court indicated that injunctions issued by some federal district courts do not apply uniformly across the entire United States.
トランプ大統領がことし1月に就任して以降、署名した大統領令をめぐっては、連邦地裁による差し止め命令が出されることも多く、それにより全米規模で政策がストップするケースが相次いでいます。
Since President Trump took office this January, many of the executive orders he has signed have been blocked by federal district courts, resulting in nationwide halts to his policies one after another.
トランプ大統領は27日、SNSに「大勝利だ」と投稿した上で、急きょ、ホワイトハウスで記者会見を開き「この決定のおかげで不当に差し止められていた多くの政策を進めるための申請ができる」と述べて、連邦最高裁の判断を高く評価しました。
On the 27th, President Trump posted on social media, saying, Its a huge victory, and then hastily held a press conference at the White House, where he stated, Thanks to this decision, we can now apply to advance many policies that had been unfairly blocked, highly praising the Supreme Courts ruling.
